1. Introduction

These Terms and Conditions (“Terms”) govern your use of the offseen mobile application (“App”), operated by offseen, located in Milan, Italy (“Company”, “we”, “our”, “us”). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

The App displays exhibition information submitted by third parties through separate partnering websites (www.theitalianartguide.com, www.lowgroundpressure.blog, www.realtear.blog) and publicly places such information on an interactive map powered by Google Maps.

2. Eligibility

You must be at least 13 years old to use the App if located in the United States (COPPA compliance), and at least 16 years old if located in the EU/EEA (GDPR minors rule). If you are under the minimum applicable age, you may only use the App with parental or guardian consent.

3. Services Provided

• The App is free to download and use for browsing exhibitions.
• Placement of exhibition information on the map may be free or paid, depending on promotions or specific agreements with the Company.The App displays publicly available event details submitted via the website, which may include personal contact information if the submitting user has provided explicit consent.
• The App does not allow direct messaging or commenting between users. Any contact occurs outside the App using the public information displayed.

4. User-Generated Content (UGC)

4.1 Submission Origin

All exhibition data is submitted through partnering websites, not directly via the App. The data is then reviewed and may be displayed in the App.

4.2 Consent to Publish Personal Data

If an exhibition submission contains personal data (such as name, email, phone, or social media handles), it will be published in the App only if the submitter has given clear, informed consent via the website submission form.

4.3 License Grant

By submitting exhibition information via one of the websites, you grant us a worldwide, non-exclusive, royalty-free, transferable license to display, distribute, and publicly perform the content within the App and related services.

4.4 Moderation Rights

We moderate all submissions before they appear. We reserve the right to reject, edit, or remove any submission at our discretion, including for legal, safety, or policy reasons.

5. Location Data

The App may request access to your device’s location to enhance the map experience (e.g., show nearby exhibitions).

• Location permissions are optional and can be managed in your device settings.
• Location data is processed according to our Privacy Policy.
• We comply with Google Play and Apple App Store location permission policies.

6. Map and Third-Party Services

The App uses Google Maps services. Your use of Google Maps in the App is subject to the Google Maps/Google Earth Additional Terms of Service and Google Privacy Policy.
The App may also use analytics, crash reporting, and other third-party services.

7. Payment and Promotions

Placement of exhibition data on the map may be a paid service unless covered by a promotion. Payment terms, if applicable, will be set out separately on the partnering websites or in a specific agreement.

8. Prohibited Uses

You agree not to:

• Submit unlawful, defamatory, obscene, or infringing content
• Interfere with the App’s functionality or security
• Attempt to collect personal data from other users without consent

9. Intellectual Property

All App content (excluding user submissions) is owned by us or our licensors. You may not copy, distribute, or create derivative works without our permission.

10. Data Retention and Deletion

We retain exhibition data for as long as necessary to provide the service or as required by law.

Users cannot delete submissions directly from the App; all removal requests must be made via email.

11. Disclaimers

• The App is provided “as is” without warranties.
• We are not responsible for the accuracy of exhibition information or for any third-party contact initiated outside the App.

12. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any damages arising from your use of the App, except in cases of gross negligence or willful misconduct.

13. Indemnification

You agree to indemnify and hold us harmless from claims arising from your use of the App, including your submissions and any violations of these Terms.

14. Changes to Terms

We may update these Terms from time to time. We will notify users of significant changes via in-app notice or on our website.

15. Governing Law

These Terms are governed by the laws of Italy. Any disputes shall be resolved in the courts of Milan, Italy.
